TERMS & CONDITIONS
- GENERAL DEFINITIONS
1.1. These Terms and Conditions regulate the contractual relationship between “the Company” and “the Customer”.
1.2. “The Company” refers exclusively to Barkers of Croydon, including its authorised personnel and drivers.
1.3. “The Customer” refers to any party who accepts an offer by the Company for its Services.
1.4. Barkers of Croydon operates from 152 Eastney Road, Croydon, CR0 3TF.
1.5. The Company is solely responsible for accepting and managing all bookings and providing transportation services directly or through its licensed drivers or sub-contractors.
1.6. “The Services” include any and all carriage, courier, or delivery services provided by the Company.
1.7. “The Contract” refers to the agreement between the Company and the Customer to provide transportation services, governed by these Terms and Conditions.
- THE CONTRACT
2.1. A binding Contract is created upon the Company’s acceptance of a Customer’s reservation, governed by these Terms and Conditions.
2.2. By making a reservation, the Customer accepts these terms.
2.3. Acceptance occurs when the Customer receives a transaction reference number from the Company or upon commencement of the transportation services, whichever is earlier.
2.4. Reservations may be amended or cancelled only after acceptance by the Company (see clause 5 for applicable fees).
2.5. To avoid being billed for a ‘no-show’, Customers must contact Barkers of Croydon control on 020 8680 2221 before leaving the pickup location.
- THE SERVICES
3.1. The Company will provide transportation services as described in its sales documentation or expressly agreed in writing with the Customer.
3.2. All marketing materials are illustrative and not binding.
3.3. Service details and pricing may change without prior notice at the Company’s discretion.
3.4. The Company may use licensed third-party sub-contractors to deliver the Services, remaining fully responsible for their provision.
- THE PRICE
4.1. Prices are based on quotes provided by the Company unless otherwise agreed in writing.
4.2. Quotations assume passengers are ready at booked times.
4.3. Prices may change without notice unless a booking is confirmed.
4.4. Unforeseen costs beyond the Company’s control may result in price adjustments.
4.5. Waiting times:
- First 10 minutes free (address pickups), thereafter £1 per minute.
- Airports free for 60 minutes after ACTUAL landing time, £5 per 15 minutes thereafter.
4.6. Non-contact after 30 minutes (address pickup) or 2 hours (airport pickup) is a “no-show” subject to cancellation charges (see clause 5).
4.7. Diversions incur a minimum £5 per stop.
4.8. Journeys on 24th & 31st December (after 18.00) incur a 100% surcharge. Journeys on 25th & 26th December & 1st January incur a 100% surcharge.
4.9. Vehicle damage by passengers incurs a minimum £70 charge, payable directly to the driver.
- CANCELLATIONS
5.1. Cancellations must be confirmed by the Company.
5.2. Cancellation fees:
- Non-contact results in a 100% charge.
- 100% charge if carrying prohibited items (clause 6).
- No-show or cancellations with less than 12 hours’ notice: 100%; otherwise £20.00.
- LUGGAGE
6.1. Drivers assist passengers with luggage loading/unloading but responsibility remains with the passenger.
6.2. The Company accepts no liability for lost or damaged luggage.
6.3. Items prohibited include hazardous substances, large cash sums, alcoholic beverages, or any item the Company deems inappropriate. Assistance dogs are permitted without extra charge.
6.4. Refusal of service due to prohibited items results in full cancellation fees (clause 5).
6.5. Unaccompanied luggage not delivered due to reasons beyond driver control will be stored at the Company’s office, incurring additional fees.
- LIABILITY
7.1. The Company is fully responsible and liable for providing all transportation services booked by the Customer.
7.2. The Company shall not be liable for delays or failures caused by events outside its reasonable control, including natural disasters, civil disturbances, government actions, power failures, strikes, traffic incidents, and flight delays.
7.3. The Customer agrees to maintain confidentiality regarding the Contract and the Company’s business, continuing beyond the Contract’s termination.
- GOVERNING LAW
8.1. This Contract is governed by the regulations of London Taxi & Private Hire (Transport for London – TfL).
- PRIVACY POLICY
9.1. The Company respects your privacy and is committed to protecting personal data. Personal data provided by Customers will only be used to facilitate bookings and provide transportation services. The Company does not sell or share personal data with third parties for marketing purposes. Personal data may be disclosed to regulatory authorities or law enforcement agencies if legally required. Customers may request access to, correction, or deletion of their personal data by contacting the Company directly.
- AMENDMENTS
10.1. The Company reserves the right to revise these Terms and Conditions at any time without prior notice. Updates will be communicated to customers.
